Summary: This analysis aims to demonstrate that coupled with the main arguments for industrial protection - foster creativity and innovation and reward the creator for taking the investment - is the regulation that meets the TRIPs - International Treaty Related to Rights Aspects of Intellectual Property - facing primarily the interests of developed countries. Found the primarily economic nature of patents and the face of difficulties these nations access to technologies for generating renewable energy and thus precluding the reach of their own sustainable development, relaxation of protection is fundamental. Public policy as a transformative intervention instruments based on democratic principles are necessary. Theoretical foundations that could justify the termination of protection are found in the socioeconomic system design. The protection through patents consistent with the neoliberal vision of a capitalism based on competition and survival of the fittest while alternatives are presented by the theories of social capital and the communitarianism, promoting cooperation and solidarity. The approach method is deductive, and the technique used, the literature of interdisciplinary character.
