This paper discusses the current oil scenario in Brazil, since the first legislative considerations to the new regulatory framework, highlighting the main obstacles and changes since the bills enacting the most current legislation. Given the changes in the legal system with the flexibility of state monopoly and the consequent creation of the exploration, development and production of oil and natural gas program, a study on the health policy of the oil activity will make itself. Will also discuss the model of the distribution of proceeds from the oil activity, that with the discovery of a potentially productive field, the pre-salt layer has been the subject of ongoing debates regarding its regulation. In search of fair and equitable compensation model legislative power has been proposing changes in the distribution of oil royalties, seeking the possibility to link the application thereof to promote public policies and guarantee of Fundamental Rights. |
