The administrative discretion enjoyed by these committees has limits, as the jurisprudence, far this reason in the present writing is to analyze if public entities must fulfill the legal precedents when they are called to reconcile far its legal and factual nature are similar to those were already judgement by the high courts.La Conciliación Extrajudicial Contenciosa Administrativa ha sido establecida, entre otras razones, con el fin de descongestionar la justicia contenciosa administrativa y evitar lesiones patrimoniales a las Entidades de Derecho Público, otorgándoles, a través de los Comités de Conciliación para la Defensa Judicial, la potestad de decidir en cada caso, la procedencia de conciliar o no.
