Laburpena: Administrative Litigation Settlement Reconciliation has been established, among other reasons, in order to relieve the administrative contentious justice and avoid injury public entities, through conciliation committees for legal defense, the power to decide in each case, the origin of reconciled or not. The administrative discretion enjoyed by these committees has limits, as the jurisprudence, far this reason in the present writing is to analyze if public entities must fulfill the legal precedents when they are called to reconcile far its legal and factual nature are similar to those were already judgement by the high courts.
