The investigation considers concepts such as: filiation, recognition, biological truth, parental authority, evidence of filiation; for which the regulation of these rights contained in the Mexican Political Constitution and the Convention on the Rights of children is taken into account; by the General Law on the Rights of children and adolescents and the relative articles of the Mexico City Civil Code. The analysis includes the interpretations that take into consideration different concepts and their corresponding regulations that make up the national doctrine, foreign and federal courts, in order to identify its applies to protect the Mexican children rights, and as a way to justify a proposal for a legal reform to the Mexico City Civil Code.Este artículo estudia el derecho a la filiación materno paterna como una garantía de plena identidad biológica de las niñas y los niños. La investigación considera conceptos como: filiación, reconocimiento, verdad biológica, patria potestad, pruebas de filiación; para lo cual se toma en cuenta la regulación de estos derechos contenidos por la Constitución Política mexicana y la Convención de los Derechos del Niño; por la Ley General de los Derechos de Niñas, Niños y Adolescentes y los artículos relativos del Código Civil de la Ciudad de México.
