This article is intended to demonstrate that judges and magistrates in Colombia have mistakenly tried to introduce an objective system that has qualified the jurisprudence in a liability regime that has never been referred to by the Colombian civil code. It is concluded that the responsibility for automotive collision in Colombia has been studied and applied from the guilt.La Corte Suprema de Justicia ha abordado el estudio del régimen de imputación de responsabilidad por colisión de automotores con el pasar del tiempo. En el transcurso de algo más de diez décadas, ha pasado del régimen de culpa presunta al régimen de responsabilidad objetiva y viceversa. Este artículo tiene por finalidad demostrar que los jueces y magistrados de Colombia han intentado, equivocadamente, introducir un sistema objetivo que ha matizado la jurisprudencia en un régimen de responsabilidad que nunca ha sido contemplado por el código civil colombiano.
