Summary: The objective of this paper is to provide an overview of the educational policy of the Spanish monarchy in the modern age (sixteenth and eighteenth centuries), through the Spanish legislation. From the policy level to what extent there was a regulation of education from infancy too the higher educational levels. The role of teachers, lectures, and other educational tools, educational programs, the obligations and rights of teachers and students, the educational control, foundation schools and, in general, any action related to the subject of education was regulation by the Castilian legal right to the modern age
