Taking into consideration the various economic cycles from the end of the last
century up to the present, we analyze the historical development of the
occupational health legislation in Mexico. Laws related to worker's health, the
regulation of these same laws, and the tracing of their emergence in different time
periods are discussed from a perspective that attemps to link together structural
phenomena that take place in Mexico and throughout the rest of the world. The
following points are also discussed: the principal features of and changes in
legislation; the passage of the Occupational Health Act ; the influence of
legislation on worker's health; neoliberal and protective interpretations of the
laws along with the role that these play in defining work conditions, and; the
formulation of a referencial framework that also reflects the changes in the
legislation of other contries.
Scanned herein are important concepts contained in the Constitution, labor and
social security laws enacted during various periods and for distinct groups of
workers, and changes in and contributions of legal regulations expressed in laws
and regulations. Our intention is to explore the way in which the right to
occupational health goes beyond a simple expanding prerogative. Up to a point,
this right to work-and- health meets the need for accumulation of capital.

Up to a point, this right to work-and- health meets the need for accumulation of capital.En este documento se analiza el desarrollo histórico de la legislación laboral en salud en México considerando los diferentes ciclos económicos que ha cursado la sociedad desde fines del siglo pasado hasta nuestros días. Las leyes relacionadas con la salud de los trabajadores y su reglamentación, son analizados desde una perspectiva que intenta articular los fenómenos estructurales que ocurren en el mundo y en México, ubicando también su surgimiento en los diferentes períodos presidenciales. En el texto se discuten los principales rasgos del Derecho y su implicación sobre la salud de los trabajadores y los cambios que ha experimentado, incluyendo el propio surgimiento del Derecho Laboral, las concepciones liberal y tutelar de las leyes, el papel que éstas tienen en la definición de las condiciones de trabajo, así como la conformación de un marco de referencia que también hace eco de los cambios que sufren las legislaciones de otros países. En el documento se repasan conceptos importantes vertidos en la Constitución, las leyes del trabajo y de seguridad social -de diferentes momentos y para distintos grupos de trabajadores- y también se señalan los cambios y aportes de la reglamentación que se expresan (o han expresado) en reglamentos, instructivos y normas.
