Summary: The new legal framework on public procurement and concession has been introduced into the Greek legal order through laws 4412/2016 and 4413/2016, respectively. Greece, like the other European countries, should abstain from adopting the exclusion of the water sector from the field of transposition of directive 2014/23/UE given that it was not obliged to adopt such an exclusion. The right to water should be consecrated in an explicit and simple manner, exempted from prejudices and distortions. Besides, there are three PPP contracts, of partly reciprocal nature, for the promotion of the new right to participate in the Information Society in less-favored areas. However, each candidate had to select a company that would make the qualitative and quantitative control of the materialization of the work, before contractor’s applications for payment. With this regulation, the selection of the best enterprise as a supervisor is not ensured.
