On July 12th, 2011, the Constitutional Court issues its decision, within the scope of case No. 1894-2011-CPR. Regarding the draft´s mechanism that proposes the registration of cybercafés users who theoretically commit such crimes with impunity, the ruling addresses controversial and relevant issues, such as equality before the law, the right to protection of private life and the principle of legal reserve. After transcribing the main foundations of the ruling and of dissenting opinions, this article proposes a series of questions and re$ections on the topics discussed.El 5 de enero de 2011, la Cámara de Diputados de Chilesomete a control preventivo de constitucionalidad un proyecto deley sobre la coacción del acoso sexual de menores, posesión dematerial pornográfico y pornografía infantil virtual o simulada,conductas definidas en los artículos 366 quáter y 366 quinquiesdel Código Penal. El 12 de julio de 2011, el Tribunal Constitucional(TC) emite su decisión, en el ámbito de la causa Rol n° 1894-2011-CPR. A propósito del dispositivo del proyecto que propone elRegistro de Usuarios de Cibercafés que, en teoría, cometen dichosdelitos impunemente, el fallo trata de temas polémicos y relevantes,tales como: la igualdad ante la ley, el derecho a la protección de la vida privada y el principio de la reserva legal.
