Summary: On January 5th, 2011, the Chamber of Deputies of Chile submits to preventive constitutional review a draft law on coercion of sexual harassment of minors, possession of pornographic material and virtual or simulated child pornography, crimes de"ned in Articles 366 quáter and 366 quinquies of the Penal Code. On July 12th, 2011, the Constitutional Court issues its decision, within the scope of case No. 1894-2011-CPR. Regarding the draft´s mechanism that proposes the registration of cybercafés users who theoretically commit such crimes with impunity, the ruling addresses controversial and relevant issues, such as equality before the law, the right to protection of private life and the principle of legal reserve. After transcribing the main foundations of the ruling and of dissenting opinions, this article proposes a series of questions and re$ections on the topics discussed.
