Summary: Mediation is an ADR that is not specifically regulated in Cuban legal system. In Spain is a tool increasingly been used since 2012, date of Spanish Mediation Law. It is obvious that gender plays a role in all legal fields. However mediation has been excluded from the field of the gender violence in Spain. And the question to be raised is: is mediation a good choice in cases of gender violence? And it could be responded from both approaches, Cuban and Spanish, because in both is a lege ferenda issue.
