The origins of education in the colonial period, imperial and Republican are presented, the latter with emphasis on the Constitution of 1988, with a special look at the rural education in contemporary Brazil. We conducted a exploratory explanatory literature, qualitative, using the hypothetical-deductive method. Although the right to education is provided for constitutionally when it relates to the education field, what you see is a disregard of the government for the peoples of the field.O presente artigo pretende analisar o Direito Fundamental à Educação, a partir de um viés da Educação do Campo, contextualizando a educação brasileira tanto historicamente, quanto politicamente. São apresentadas as origens da educação nos períodos colonial, imperial e republicano, este último com ênfase na Constituição Federal de 1988, com olhar especial para a educação do Campo no Brasil contemporâneo. Realizou-se uma pesquisa bibliográfica exploratório-explicativa, qualitativa, utilizando-se o método hipotético-dedutivo.
