Summary: This article aims to analyze the Fundamental Right to Education, from a bias of Rural Education, contextualizing the Brazilian education both historically and politically. The origins of education in the colonial period, imperial and Republican are presented, the latter with emphasis on the Constitution of 1988, with a special look at the rural education in contemporary Brazil. We conducted a exploratory explanatory literature, qualitative, using the hypothetical-deductive method. Although the right to education is provided for constitutionally when it relates to the education field, what you see is a disregard of the government for the peoples of the field.
