The aim of our paper is to analyze the ch
anges that the second
chance regime presents after the amendment introduc
ed by Law 25/2015 of July 28, of
second chance mechanism, reduction of the financial
burden and other measures of
Social order, in order to check if the numerous sho
rtcomings of the previous regulation
provided in Law 14/2013 of September 27, on support
for entrepreneurs and their
internationalization have actually been addressed.
Our paper is completed with an
approximation to the second chance regime envisaged
in the United States, as it is
considered the most favorable for the insolvency si
tuation of the natural personal
debtor. |
