The European courts have not reach yet a common position. This paper explains where the problem comes from and collects the judicial decisions issued by both Spanish and German courts, and the problems that are still to come and that make it hard for customers to trust Volkswagen againCasi un año después de que se destapase el escándalo Volkswagen, y siendo la incertidumbre la tónica que sigue predominando en los propietarios de vehículos equipados con el motor diésel EA 189 Euro 5 de Volkswagen, algunos se han aventurado ya en la batalla legal contra los concesionarios y la matriz Volkswagen A.G. con las más diversas pretensiones: la sustitución del vehículo por uno nuevo, la devolución del precio o la indemnización de daños y perjuicios, sin que por el momento exista una posición jurisprudencial uniforme al respecto.
