Summary: Almost a year after the notice of violation of the American Clean Air Act by Volkswagen, the owners of such cars are still worried about the measures needed to adjust their cars’ engine diesel EA 185 Euro 5 to the requirements of the european legislation. Some of the customers have already entered into a legal battle against auto dealers and Volkswagen A.G., expecting to get a new car instead of the defective one, or asking for a compensation. The European courts have not reach yet a common position. This paper explains where the problem comes from and collects the judicial decisions issued by both Spanish and German courts, and the problems that are still to come and that make it hard for customers to trust Volkswagen again
