The application of proportionality in the context of a collegial decision requires the development of an argumentative reasoning which, in turn, depends on the fulfillment of deliberation in the strict sense, which, essentially for reasons of institutional nature, is not the case in the Brazilian's Supreme Court.Embora se verifique um número considerável de referências à proporcionalidade em decisões de ministros do STF, não é acertado concluir que a nossa corte constitucional aplique a máxima da proporcionalidade.
