Second, it highlights the problems involved in the application of vicarial system to those individuals declared almost incompetent (art. 21.1). An exploratory research in a Spanish prison shows the situation of the mentally ill that fulfill their sentences in ordinary prisons.El presente trabajo tiene como objetivo abordar la situación actual del enfermo mental en el medio penitenciario desde dos puntos de vista diferentes. En primer lugar, dedica una especial consideración a las consecuencias jurídico-penales aplicables a los sujetos declarados inimputables en virtud de la concurrencia de un supuesto de anomalía o alteración psíquica prevista en el art. 20.1 CP. En segundo lugar, resalta los problemas que conlleva la aplicación del sistema vicarial a aquellos sujetos declarados semiimputables (art. 21.1.CP).
