That is, these functions allow both the social order and cohesion, as well as the achievement of social objectives (whether they be security, justice, peace, economic development, etc.). In this sense, it has aimed to analyze the theory of social structure from two great thinkers of the sociological school, Talcott Parsons and Robert Merton, each with a proposal to the understanding of society from the different elements that compose it, and how through them, any company can achieve social cohesion and societal goals proposed. Therefore, we analyze the right from its instrumental character from the sociological theory of structural functionalism, which allows enthrone in the study of society from their elements and functions.Resumen: La función principal del derecho es la consecución del orden social, que es la principal finalidad de cualquier sociedad. Sin embargo, dicha finalidad no caracteriza en su totalidad al derecho, éste, a través de sus funciones también se convierte en un instrumento que permite la realización de los objetivos sociales. Es decir, dichas funciones permiten tanto el orden social y la cohesión, al igual que el logro de objetivos sociales (llámense seguridad, justicia, paz, desarrollo económico, entre otros). En este sentido, se ha planteado analizar la teoría de la estructura social desde dos grandes pensadores de la escuela sociológica, Talcott Parsons y Robert Merton, cada uno con una propuesta tendiente a la comprensión de la sociedad desde los diferentes elementos que la componen, y cómo a través de ellos, cualquier sociedad puede lograr la cohesión social y los objetivos societales que se proponga.
