Sumario: The difficulties encountered in the implementation of the quotas gave rise to the debate on political parity of gender in Latin America. The principle of parity is expressed in a norm that forces political parties to make rosters of candidates with 50% of members of each gender, organized in a sequential and alternate manner. In spite of the high potential of gender equality and equity comprised in this principle, when parity norms are integrated into a particular electoral system, the elements of the normative framework condition its efficiency, as it is the case of the quota system. Thus, an equitable electoral legislation which is highly favorable for the political participation of women is not enough when the design of the electoral system and the way in which parties and alliances make their rosters, giving priority to male candidacies; act as obstacles for their access. The article presents data of the results in parity election at a sub-national level in Costa Rica and Argentina, which support this hypothesis
