The Spanish law 17/2009 of 23 November, on free access to service activities and its exercising, which transposes the cited Directive, adopts the same approach and therefore, excludes land transport services from its scope. However, the aim of this study will be the analysis of Law 25/2009, of December 22, which amends various laws in order to adapt them to the Law on free access to service activities and its exercising, introducing changes in certain provisions of other state laws relating to transport by land and rail.El Tratado de Roma utilizó la expresión «servicio público» para referirse a los transportes terrestres y, en su desarrollo, los servicios de transporte terrestre se sujeta a una regulación propia, quedando excluidos del ámbito de aplicación de Directiva 2006/123/CE, del Parlamento Europeo y del Consejo, de 12 de diciembre, relativa a los servicios en el mercado interior. Así lo establece también la Ley española 17/2009, de 23 de noviembre, sobre el libre acceso a las actividades de servicios y su ejercicio, de trasposición de la Directiva.
