Sumario: The Treaty of Rome used the term «public service» to refer to land transport and in its development, land transport services are subject to its own proper regulation, being excluded from the scope of Directive 2006/123/EC of European Parliament and Council of 12 December on services in the interior market. The Spanish law 17/2009 of 23 November, on free access to service activities and its exercising, which transposes the cited Directive, adopts the same approach and therefore, excludes land transport services from its scope. However, the aim of this study will be the analysis of Law 25/2009, of December 22, which amends various laws in order to adapt them to the Law on free access to service activities and its exercising, introducing changes in certain provisions of other state laws relating to transport by land and rail.
