It aspire to demonstrate that, despite having ratified the American Convention on Human Rights in 1992 and have recognized the jurisdiction of the Court in 1998, there are no legal mechanisms capable to provide effectiveness to the court decisions in Brazil. It was concluded that Brazil needs an specific law to give practical effect to the sentences handed down by the Court. Therefore, it’s necessary to establish clear procedures that would occur in the administrative field, and the non-compliance would be considered an affront to the principles of human dignity and democratic state of law by the Brazilian judiciary.O texto objetiva a análise da implementação das decisões da Corte Interamericana de Direitos Humanos em Brasil. Pretende-se demonstrar que, apesar de ter ratificado a Convenção Americana de Direitos Humanos em 1992 e de ter reconhecido a jurisdição da Corte em 1998, não há mecanismos jurídicos capazes de fazer as decisões do tribunal eficazes no Brasil. Chegou-se a conclusão que o Brasil precisa de uma legislação que procura dar concreta efetividade às sentenças proferidas pela Corte. Para o tanto, é necessá- rio o estabelecimento de procedimentos claros, que ocorram no âmbito administrativo, mas cuja inobservância seja considerada pelo judiciário afronta aos princípios de Dignidade da Pessoa Humana e do Estado Democrático de Direito.El texto objetiva el análisis de la implementación de las decisiones de la Corte Interamericana de Derechos Humanos en Brasil. Se pretende demostrar que, a pesar de haber ratificado la Convención Americana de Derechos Humanos en 1992 y de haber reconocido la jurisdicción de la Corte en 1998, no hay mecanismos jurídicos capaces de hacer las decisiones del tribunal eficaces en Brasil. Se llegó a la conclusión que Brasil necesita de una legislación y procura dar concreta efectividad a las sentencias proferidas por la Corte.
