The retributive paradigm crisis that has been ongoing since the mid-twentieth century, as
a unique mechanism to achieve a speedy and effective justice, has led to the emergence of
new ways to impart, highlighting the need to consider the victim as a central component of
process. There is no doubt that the offense is much more than a category of legal doctrine, is
primarily a measure producing specific damage in a person that results in different forms of
victimization that extend its negative effect on the persons and in society. Therefore, today's
ethical stance encourages us to establish another way to deliver justice. A victim-centered
justice and the task of repairing the damage, through the active participation of the victim
and the victimizer. Justice to repair, to gather and to convene and separating, produce injustice
perpetuated revenge

Não há dúvidas de que o crime é muito mais do que uma categoria da dogmática jurídica; é acima de tudo um ato que produz um dano concreto em uma pessoa que da lugar a distintas formas de vitimização que amplia o efeito negativo na pessoa(s) e na sociedade. Por isso, a postura ética de hoje nos impulsiona a estabelecer outra forma de brindar justiça. Uma justiça centralizada na vitima e na tarefa de reparar o dano, mediante a participação ativa da vitima e do verdugo. Uma justiça que repare, que reúna e que convoque e que não separe, produza vingança perpetue a injustiça.La crisis del paradigma retributivo que se ha venido dando desde mediados del siglo XX, para alcanzar una pronta y efectiva justicia, ha conducido a la emergencia de nuevas formas de impartirla, evidenciando la necesidad de contemplar a la víctima y la reparación como componentes centrales del proceso. No cabe duda de que el delito es mucho más que una categoría de la dogmática jurídica; es ante todo un acto que produce un daño concreto en una persona, y que da lugar a distintas formas de victimización que amplían su efecto negativo en las personas y en la sociedad. Por ello, la postura ética de hoy nos impulsa a establecer otra forma de brindar justicia. Una justicia centrada en la víctima y en la tarea de reparar el daño, mediante la participación activa de la víctima y del victimario.
