The article gives account for the case study
carried out in the Pediatric University Hospital
of the Puerto Rico Medical Center, located in San
Juan, Puerto Rico. Its main goal is to establish if
the practice of the Substituted Consent provided
by the parents or legal representatives of
youngsters who present intersexuality conditions,
sexual ambiguity and hermaphroditism that
require, at the same time, surgical interventions
or relocation or sex change. Thus, the juridical
figure of the Informed Consent corresponded
as well with the rights claimed by the Universal
Declaration of Human Rights and the policies that
develop it. Additionally, the research performed
a comparative analysis between the juridical
treatment given in the hospital facility in these
types of processes and the jurisprudentially
established treatment throughout Unified
Judgment by the Constitutional Court of Colombia
for equal circumstances.

Additionally, the research performed a comparative analysis between the juridical treatment given in the hospital facility in these types of processes and the jurisprudentially established treatment throughout Unified Judgment by the Constitutional Court of Colombia for equal circumstances.Este artigo apresenta o estudo de caso realizado no Hospital Pediátrico Universitário do Centro Médico de Porto Rico, localizado em San Juan, Porto Rico, que teve como finalidade determinar se a prática do consentimento substituto dos pais ou responsáveis legais, dos menores de idade que apresentam condições intersexuais, ambiguidade sexual e hermafroditismo e requerem intervenção cirúrgica de readequação ou mudança de sexo, corresponde à figura jurídica do Consentimento Informado, da mesma forma que os direitos consagrados pela Declaração Universal dos Direitos Humanos e os regulamentos de execução. Adicionalmente, foi realizada uma análise comparativa em relação ao tratamento jurídico aplicado na instituição médica em tais casos, e a jurisprudência estabelecida pela Sentença de Unificação do Tribunal Constitucional da Colômbia para circunstâncias iguais.El artículo que se presenta a continuación da cuenta del Estudio de Caso realizado en el Hospital Pediátrico Universitario del Centro Médico de Puerto Rico, ubicado en San Juan, Puerto Rico, que tuvo como finalidad establecer si la práctica del Consentimiento Sustituto tomado a los padres o representantes legales de los menores que presentan condiciones de intersexualidad, ambigüedad sexual y hermafroditismo que requieren a la vez de intervenciones quirúrgicas de readecuación o cambio de sexo, se correspondía con la figura jurídica del Consentimiento Informado al igual que con los derechos proclamados por la Declaración Universal de Derechos Humanos y las normas que la desarrollan.
