Summary: The article gives account for the case study carried out in the Pediatric University Hospital of the Puerto Rico Medical Center, located in San Juan, Puerto Rico. Its main goal is to establish if the practice of the Substituted Consent provided by the parents or legal representatives of youngsters who present intersexuality conditions, sexual ambiguity and hermaphroditism that require, at the same time, surgical interventions or relocation or sex change. Thus, the juridical figure of the Informed Consent corresponded as well with the rights claimed by the Universal Declaration of Human Rights and the policies that develop it. Additionally, the research performed a comparative analysis between the juridical treatment given in the hospital facility in these types of processes and the jurisprudentially established treatment throughout Unified Judgment by the Constitutional Court of Colombia for equal circumstances.
