The purpose of this paper is to lay down the scope of said concept, in order to avoid a breach of both principles of legal certainty and legitimate expectations. Overriding said scope might arise the State liability for wrongful lawmaking.En los últimos años se ha producido en España una reforma estructural del sector eléctrico, que ha supuesto una reducción drástica del sistema de ayudas que reciben las empresas del sector de las energías renovables. Dicha reducción se ha apoyado en el concepto de «riesgo regulatorio», de origen jurisprudencial. El objeto de este trabajo consiste en fijar los límites inherentes a dicho concepto, con el fin de evitar una vulneración de los principios de seguridad jurídica y confianza legítima.
