Summary: The electrical energy sector in Spain has been structurally reformed lately, so that the financial aid to the renewable energy companies has been drastically reduced. Said reduction has been substantiated in the case-law concept of «regulatory risk». The purpose of this paper is to lay down the scope of said concept, in order to avoid a breach of both principles of legal certainty and legitimate expectations. Overriding said scope might arise the State liability for wrongful lawmaking.
