To achieve the intended purpose, we will dwelve into hegemonic conceptions of justice and epistemological.En el artículo se pretende describir la ideología normativa presente en la motivación judicial del denominado Estado Legislativo. Para cumplir dicho propósito se rastrearán las distintas acepciones sobrela denominación “motivación judicial”; se aportará una breve referencia histórica sobre la construcción del mencionado concepto; se explicarán los postulados del Estado Legislativo y su relación con el silogismo jurídico; y finalmente enunciará las razones de su desencanto o pérdida de hegemonía.
