Summary: The influence of the anarco-unionism is sufficiently visible in the Brazilian syndical structure in the period of Getúlio Vargas during the validity of the New State (1938-1945). However, the ideas of the anarco-unionism and the socialism had not obtained to prevail on the Brazilian unionism that started if to develop, supported for the Church and the State, that saw with fear an independent and revolutionary syndical organization. The systematization conferred for the Consolidation of the Laws of Work – CLT, with 1943, endowed Brazil of a syndical structure with corporative raízes of Italian conception. The results intended with the syndical structure from the CLT, were to provide state control through the legal guardianship, of all the relations between workers and masters. All the Brazilian syndical structure was based on the criterion of the unicity. The conceptual bedding of the freedom unionization meets in the rules and orientations of the International Organization of Work -OIT inserted. With the promulgation of the Federal Constitution of 1988, the Brazilian unionism gained greater freedom, being forbidden to the State to intervene with the organization and, syndical administration. However, the principle of the syndical unicity was kept. The lack of an effective freedom unionization, allied the economic policies and social of the federal government in all the periods of the history of the Brazilian unionism, if have reflected with greater or minor intensity in the anti-syndical practical called ones that finish imposing limits to the syndical right of action.
