Its origins, its nature, evolution and currency, its tendencies and its present contradictions, its application in the international context in the ideological, political and the economic transformations of the last three decades and its current application in telecommunications are analyzed. The democratic elements of the Theory of Public Service recovers force to rescue the public in the direct provision of essential public services by the state, by the use of Administrative Law and administrative proceedings to resolve its conflicts and as an alternative to private enterprise and mercantilist concepts. In the part relevant to the research carried out, historical and logical methods were integrated with analysis and synthesis; primary sources and secondary sources were used as well as a documentary analysis.La Teoría del Servicio Público desde sus orígenes en Francia en la segunda mitad del siglo XIX hasta nuestros días, ha tenido una importante influencia en Colombia y en el mundo occidental. Se analizan sus orígenes, su naturaleza, evolución y vigencia, sus tendencias y sus contradicciones actuales, su práctica en el contexto internacional de las transformaciones ideológicas, políticas y económicas de las últimas tres décadas y su aplicación actual en las telecomunicaciones. Los elementos democráticos de la teoría del Servicio Público recobran vigencia para el rescate de lo público, de la prestación directa delos servicios públicos esenciales por parte del Estado, la utilización del derecho administrativo y la jurisdicción contencioso administrativa para resolver sus conflictos y como alternativa a las concepciones privatistas y mercantilistas predominantes.
