The acknowledgment that the fundamental rights bind directly individuals
didn´t erase the limitations problem. Regarding the horizontal
effectiveness of fundamental rights, such limitations are
usually derived from acts of autonomous will. This paper initially
aims to deny the possibility of using the proportionality principle
as a balance process tool triggered by acts of private autonomy
restricting fundamental rights. Then, it is presented the distinction done by Humberto Ávila between the proportionality and reasonableness
principles objecting that the reasonableness can be
used as an alternative to lead the balance between private autonomy
and fundamental rights of individuals. |
