regulation in the Brazilian Constitution and in the Portuguese
Constitution. We conclude that with the advent of
Constitutional Amendment 32, we hold which it started admitting
autonomous regulations with regard to abolishing positions and
public office vacant as well as for the organization and operation
of Federal Public Administration and the independent regulations
are outlined in the Portuguese Constitution need an enabling law,
whose breach entails the formal unconstitutionality of the statute.

Primeiramente, discutimos acerca do princípio da separação de poderes e explanamos sobre o regulamento e, em seguida, investigamos este na Constituição Brasileira e na Constituição Portuguesa. Concluímos que, com o advento da Emenda Constitucional n. 32, aquela passou a admitir os regulamentos autônomos no que tange à extinção de cargos e funções públicos vagos, assim como relativamente à organização e ao funcionamento da Administração Pública Federal. Ainda, os regulamentos independentes delineados na Constituição Portuguesa necessitam de uma lei habilitadora, cuja preterição enseja a inconstitucionalidade formal do diploma.El presente artículo tiene como objetivo analizar y reflexionar si los reglamentos independientes violan al principio de la separación de los poderes, considerando estos institutos en el orden constitucional portugués y brasileño. En primer lugar, discutimos sobre el principio de la separación de los poderes y comentamos sobre el reglamento y, en seguida, analizamos este en la Constitución Brasileña y en la Constitución Portuguesa. Llegamos a la conclusión de que, con el advenimiento de la Enmienda Constitucional n. 32, aquella pasó a admitir los reglamentos autónomos en lo que se refiere a la extinción de cargos y funciones públicas vacantes, así como relativamente a la organización y al funcionamiento de la Administración Pública Federal.
