To show this, three points are developed: firstly, the ethical principles of the fundamental human rights are shown; secondly, the relationship between humanism and human rights is studied in depth; and finally, it concludes with decision making and fundamental human rights. In this sense, the hypothesis defended in this paper reads as follows: �human rights are supported by some moral principles which involve human beings both, from their theoretical condition, and from their practical condition in the world.�Este artículo devela algunos conceptos éticos que subyacen en los derechos humanos plasmados en la Constitución Política de Colombia de 1991. La ética que predomina en este escenario es la ética deontológica, sobre todo la teoría formal del comportamiento moral de Kant. Para mostrar esto se desarrollan tres puntos: en primer lugar, se muestran los principios éticos de los derechos fundamentales; en segundo lugar, se profundiza en la relación entre humanismo y derechos; fi nalmente, se concluye con la toma de decisiones y los derechos fundamentales.
