The proposed model attributes the will from which the administrative act emerges to the State and suggest that such will is segmented into two hierarchies: legislative and administrative.Existem diferentes concepções sobre o papel da vontade como elemento de validade de um ato administrativo regulamentado. Foi realizada uma revisão integrativa da literatura que revelou as quatro explicações concorrentes. Foram identificadas falhas importantes em todas as quatro explicações e, como conseqüência, é proposto um modelo alternativo que as resolve com sucesso. O modelo proposto atribui ao Estado a vontade a partir da qual o ato administrativo emerge e sugere que esta vontade seja segmentada em duas hierarquias: legislativa e administrativa.Existen diferentes concepciones acerca del rol de la voluntad como elemento de validez del acto administrativo reglado. Se ejecutó una revisión de literatura integrativa que reveló las cuatro explicaciones en pugna. Deficiencias importantes fueron identificadas en las cuatro explicaciones y, como consecuencia, se propone un modelo alternativo que las resuelve exitosamente.
