The minimum wage right has an imprecise and elusive definition. It has a marked emphasis on its social aspect. In recent years, the vital mínimum right is being materialialized legally in several positive law contries. In Ibero-America, this right is also increasingly claimed by certain social groups. In 2017, the European Union encouraged its adoption by the Member States as an incentive to fight poverty, but only after the social crisis caused by the COVID-19 pandemic it is beginning to take off. Thus, in May 2020 the minimum vital income was approved in Spain, a reason that serves as a starting point for the analysis that we will carry out in this work. o Inn a Latin American potential regulationis being expected. For this, a logical-deductive methodological scheme has been followed, going from the analysis of the original concept to its various normative and jurisprudential expressions, all through documentary, historical, and systemic techniques, to finally propose a hypothesis that bets on global implementation.

Nos últimos anos, o direito ao mínimo vital tem vindo a passar de um debate meramente doutrinário para a sua materialização na realidade jurídica de vários países. Na América Latina, este direito é cada vez mais reivindicado por certos grupos sociais. Em 2017, a União Europeia incentivou a sua adopção pelos Estados-Membros como incentivo ao combate à pobreza, mas só após a crise social provocada pela pandemia da COVID-19 é que parece começar a ser implementado. Assim, em Maio de 2020, o rendimento mínimo de subsistência foi aprovado em Espanha, o que serve de ponto de partida para a análise que este documento irá realizar do seu conceito e natureza, o que servirá de guia para as reflexões que, em termos latino-americanos, serão realizadas sobre a sua potencial regulamentação e aplicação neste lado do Atlântico. Para tal, seguiu-se um esquema metodológico lógico-dedutivo, que vai desde a análise do conceito original até às suas diversas expressões normativas e jurisprudenciais, tudo isto através de técnicas documentais, históricas e sistémicas, para finalmente avançar com uma hipótese que aposta na implementação global deste instrumento na América Latina.El derecho al mínimo vital constituye un significante impreciso y escurridizo en torno a su definición, el cual vendría a encarnar la culminación de los derechos de segunda generación con un marcado énfasis en su vertiente social. En los últimos años, el derecho al mínimo vital está realizando el tránsito desde el debate meramente circunscrito a los círculos doctrinales hasta su materialización en realidad legal en varios países. En Iberoamérica, este derecho es, además, reivindicado cada vez con más potencia por determinados colectivos sociales. En 2017 la Unión Europea incentivó su adopción por parte de los Estados miembros como acicate para luchar contra la pobreza, pero únicamente tras la crisis social provocada por la pandemia del COVID-19, pareciera que comienza a ponerse en marcha. Así, en mayo de 2020 el ingreso mínimo vital fue aprobado en España, razón que sirve como punto de partida al análisis que en este trabajo se realizará de su concepto y naturaleza, el cual servirá de guía a las reflexiones que, en clave latinoamericana, se llevará a cabo en cuanto a su potencial regulación y aplicación a este lado del Atlántico.
