This research is of great importance for the development of commercial traffic and, therefore, of the Cuban economy. Its objective is: To substantiate the need for effective regulation of a theoretical-legal framework that represses acts that constitute unfair competition in the Cuban legal system. It summarizes the doctrinal guidelines for the study of the events that lead to unfair competition, establishing a critical analysis from a positive perspective for its proper application in the Cuban legal system, demonstrating the need to regulate them, with the aim of guaranteeing their effective repression. The palpable economic value that stands in the competition, forges the implementation of measures for its legal protection. Despite the transformations carried out in Cuba in terms of Intellectual Property, insufficiencies are still observed, which require special attention, in terms of the legal regulation of unfair competition. The implementation of a regulation that substantively regulates this institution with reference to developing norms, constitutes a necessity in terms of the protection of consumers, businessmen and the interests of both. The main expected results with the development of this research are, in the academic order: To establish the doctrinal guidelines for the study of the acts that constitute unfair competition, establishing a critical analysis from a positive perspective for its adequate application in the Cuban legal system; in the normative order: Demonstrate the need for the regulation of acts that constitute unfair competition in the Cuban legal system, with the intention of guaranteeing its effective repression.

Seu objetivo é fundamentalmente a necessidade de uma regulamentação efetiva do quadro teórico-jurídico, que reprima os atos que constituem concorrência desleal no ordenamento jurídico cubano. Resume a doutrina para o estudo dos fatos que envolvem concorrência desleal, propondo uma análise crítica, desde uma perspectiva positiva para sua adequada aplicação no ordenamento jurídico cubano, tornando visível a necessidade de regulá-los, com o objetivo de garantir sua efetiva repressão. O valor econômico palpável que se destaca na concorrência, pela implementação de medidas para sua proteção legal. Apesar das transformações ocorridas em Cuba em matéria de Propriedade Intelectual, ainda se observam insuficiências, que requerem especial atenção, em termos de regulamentação legal da concorrência desleal. A implementação de um regulamento que regulamente substantivamente esta instituição com referência a normas desenvolvidas, constitui uma necessidade em termos de protecção dos consumidores, empresários e dos interesses de ambos. Os principais resultados esperados são, de ordem acadêmica: estabelecer as diretrizes doutrinárias para o estudo dos atos que constituem concorrência desleal, apresentando uma análise crítica desde uma perspectiva positiva para sua adequada aplicação no ordenamento jurídico cubano; e, de ordem normativa: demonstrar a necessidade de regulamentar os atos que configuram concorrência desleal no ordenamento jurídico cubano, com o intuito de garantir sua efetiva repressão.La investigación revierte importancia para el desarrollo del tráfico mercantil y por extensión de la economía cubana. Su objetivo es fundamentar la necesidad de una regulación efectiva del marco teórico-jurídico, que reprima los actos que constituyen competencia desleal en el ordenamiento jurídico cubano. Compendia la doctrina para el estudio de los eventos que conllevan competencia desleal, estableciendo un análisis crítico, desde una perspectiva positiva para su adecuada aplicación en el ordenamiento jurídico cubano, visibilizando la necesidad de regularlos, con el afán de garantizar su efectiva represión. El palpable valor económico que se erige en la competencia, forja la implementación de medidas para su protección legal. Pese a las transformaciones realizadas en Cuba en materia de Propiedad Intelectual, aún se observan insuficiencias, que requieren especial atención, en cuanto a la regulación jurídica de la competencia desleal. La implementación de una normativa que regule sustantivamente esta institución con remisión a normas desarrolladoras, constituye una necesidad en cuanto a la protección de consumidores, empresarios y de los intereses de ambos.
