Many of the objects with which legal science works can be approached from a theoretical, empirical and quantitative dimension. For this purpose, Ecuadorian legislation and national doctrine were examined from various perspectives, making use of scientific articles and theses, digital repositories, with the use of methodological instruments such as the documentary record. It is concluded that, the institutional policies to be considered before the full implementation of the 5G Network, part of the evaluation made by the Legislature including the Judiciary Council before the latent, imminent, real and determined risks of technical character linked to the criminal conduct.El objetivo de la investigación fue analizar jurídicamente la red 5G y su impacto en las Ciencias jurídicas desde la perspectiva penal. La investigación se desarrolló desde el paradigma cuantitativo, además se enmarcó desde un diseño documental-bibliográfico. Muchos de los objetos con los que trabaja la ciencia jurídica pueden abordarse desde una dimensión teórica, empírica, cuantitativa. Para lo cual se examinó la legislación ecuatoriana y la doctrina nacional, según varias perspectivas, haciendo uso de artículos científicos y tesis, repositorios digitales, con la utilización de instrumentos metodológicos como la ficha documental.
