Sumario: In Ecuador, persons deprived of liberty who have been victims of torture, cruel, inhuman and degrading treatment by prison staff have activated habeas corpus as a means of defense for the protection of the right to freedom, in this context, this study It defines two Social Rehabilitation Centers as a field of action: Turi and Latacunga, the analysis of the sentences issued on the persons deprived of liberty that triggered the habeas corpus guarantee allows comparing the resolutions of the judges taking as reference the mandates of the Constitution of the Republic of Ecuador and the Organic Law of Constitutional Guarantees and Constitutional Control. The results of this analysis denote the importance of protecting the rights of people in particular the right to freedom. In this paper the theoretical methodological perspective was used with the qualitative approach.
