In this paper, the subjective and objective scope of this exemption from liability is analysed, with particular attention to its connection with the protection of trade secrets. For this purpose, the transposition of Directive 2019/1937 requires the study of the affected European and Spanish regulations, as well as knowledge of the national and European judicial doctrine on the same.Entre las garantías que protegen a la persona denunciante, en la Directiva 2019/1937, se encuentra la inmunidad por revelar secretos o información confidencial, toda vez que la persona que denuncie o haga una revelación pública, de conformidad con la citada Directiva y siempre que tenga motivos razonables para pensar que revelar esa información (secreta o confidencial) es necesaria, no se considerará que hayan infringido ninguna restricción de revelación de información y no incurrirá en responsabilidad "de ningún tipo". En este trabajo, se analiza el ámbito subjetivo y objetivo de esta exención de responsabilidad, con especial atención a su conexión con la tutela de los secretos empresariales.
