Summary: The phenomenon of misinformation has been present throughout history, but its main problem today is its “democratization”. The constant access to social networks and instant messaging applications means that false news has an unprecedented impact and reach, and a single user, from their mobile device, is capable of reaching hundreds of people. In the past, this kind of disinformation could only be disseminated by institutions or organizations with a lot of power, whereas now, with tools like those mentioned, anyone can spread misinformation. In some cases, this can cause a serious attack on the veracity of the facts, distorting the reality of the population and creating a lack of trust in official institutions, ultimately disrupting social peace and peaceful coexistence in society. Therefore, this article explores the possibility of defining a new crime that includes misinformation as an alternative and effective response to this threat.
