NFT are overtaking blockchain and cryptocurrencies in popularity. These are ownership certificates stored on a blockchain and backed by blockchain technology (for example, Ethereum). NFT are often associated with a digital asset, such as visual art, video, music, or collectibles. They seem to be called to play a key role in the so-called metaverse, a digital environment that operates on the blockchain, where technologies such as virtual reality and augmented reality act as providers of visual components, and that offer business opportunities and unlimited social interaction. Art is just a part of the blockchain-based virtual world where avatars, plots of land, buildings, names, etc., can be bought and sold as NFT. This phenomenon creates a number of interesting legal implications. The creation, distribution, ownership and trade of NFT are new phenomena that raise a multitude of legal questions, many of which are ambiguous or unresolved. In this context, the present paper analyzes international jurisdiction issues in disputes relating to non-fungible tokens, with special attention to European law. Recent case law from third States in the field of crypto assets is also assessed.

Se trata de certificados de propiedad almacenados en una cadena de bloques y respaldados por la tecnología blockchain (p. ej., Ethereum) que suelen estar asociados a un activo digital, como las artes visuales, los vídeos, la música o los objetos de colección. Los NFT parecen estar llamados a jugar un papel clave en el denominado metaverso, un entorno digital que opera en la cadena de bloques, donde tecnologías como la realidad virtual y la realidad aumentada actúan como proveedores de componentes visuales, y que ofrece oportunidades de negocio e interacción social ilimitadas. El arte es solo una parte del mundo virtual basado en blockchain donde los avatares, la tierra, los edificios, los nombres, etc., se pueden vender y comprar como NFT. Este fenómeno crea obviamente una serie de implicaciones legales novedosas. La creación, la distribución, la propiedad y el comercio de los NFT son fenómenos nuevos que plantean multitud de cuestiones jurídicas, muchas de las cuales son ambiguas o no están resueltas.
