The Russian Federation’s aggression against Ukraine is but the last piece of a chain of the gravest breaches of its commitments towards the Council of Europe. It has ended by the application of the strictest technical resource foreseen by the Statute: the expel of Russia. This has been so despite the fact that obscurity of relevant provisions to be applied, lack of previous practice on the issue and Russia’s attitude have made the overall procedure more difficult to understand. Russia’s situation with regard to CoE conventions to which it was a party differs from one case to another, but in general terms the organisation’s approach is more prone to the exclusion of Russia from any participation to the said treaties. Undoubtedly, the most relevant consequence of this situation is Russia’s withdrawal from the ECHR and impunity that will preside human rights breaches which could not be included in the extra six month period established by the ECHR, additionally to difficulties in the overall development of judicial procedures before the ECtHR and ways to secure Russia’s compliance with judgments issued by the ECtHR. New challenges also arise with regard to compliance of Russia with its financial obligations and the situation of CoE civil servants with Russian nationality.

New challenges also arise with regard to compliance of Russia with its financial obligations and the situation of CoE civil servants with Russian nationality.La agresión de la Federación Rusa contra Ucrania constituye el último eslabón de una cadena de graves incumplimientos por parte de Rusia de sus obligaciones para con el Consejo de Europa, y ha culminado con la aplicación del expediente técnico más grave y contundente previsto en su Estatuto, la expulsión, pese a que la indefinición de las disposiciones aplicables, la falta de práctica previa y la actitud de Rusia hayan oscurecido la comprensión del proceso que ha conducido a ella. La situación de Rusia respecto de los tratados internacionales del Consejo de Europa con los que se había comprometido varía, aunque en general la posición de la organización tiende claramente a excluirla de ellos. Sin duda la consecuencia más relevante es la denuncia de Rusia del CEDH y la impunidad en la que quedarán los hechos que no puedan incluirse en el periodo adicional de seis meses previsto en el CEDH, además de las dificultades en el desarrollo de dichos contenciosos y la ejecución, en su caso, de las sentencias condenatorias que dicte el TEDH.
