With Russia’s invasion of Ukraine and the armed conflict it has generated, the International Criminal Court has regained its central role in the emerging International Criminal Justice System and has once again been perceived as a useful instrument in the fight against impunity for the most serious crimes under international law. However, the complexity of the Ukrainian situation makes it necessary to view the Court’s action with caution and, above all, to place conveniently what it can ask and what can be expected of it. In this context, this paper offers an initial study of issues relating to its competence, jurisdiction, and the role that the principle of complementarity can play. |
