Summary: This article identifies that in terms of both international and national legislation that guarantees the right to higher education of people with intellectual disabilities, significant progress has been made; However, there is still a long way to go since it is necessary that this planned formal equality of the different regulatory bodies be executed in higher education institutions (HEIs) because only their practice will allow the exercise and enjoyment of the right alluded to, the opposite discriminates and converts the constitution and international instruments into lyric poetry, utopia, a goal to be achieved, but not a reality, a situation that contradicts what is stated in the constitution, referring to the fact that Ecuador is an inclusive country.
