The appointment of constitutional judges has provoked intense political debates, even calling into question the independence of the court and the separation of powers. Despite the fact that the intervention of the powers of the State in this election should be a sufficient guarantee to ensure due compliance with democratic values and principles, as well as to provide the institution with the necessary legitimacy, we have been witnessing, for years, a greater difficulty in avoiding the influence of political forces in the appointment of these judges. For this reason, and for the sake of preserving the rule of law, it is very necessary to insist on the conviction that the technical-legal element should take precedence over political considerations when applying the requirements and demands set forth in the different legal systems. Received: 21.04.2023Accepted: 13.06.2023Aunque no es una cuestión nueva, la situación de la independencia judicial en Europa ha provocado una inusitada atención. La designación de los jueces constitucionales ha suscitado intensos debates políticos, llegando a poner en tela de juicio la independencia del órgano jurisdiccional y la separación de poderes. A pesar de que la intervención de los poderes del Estado en dicha elección debería ser suficiente garantía para dar debido cumplimiento a los valores y principios democráticos, así como dotar a la institución de la legitimación necesaria, estamos asistiendo, desde hace años, a una mayor dificultad para evitar la influencia de las fuerzas políticas en la designación de estos jueces. Por este motivo, y en aras de la preservación del Estado de Derecho, es muy necesario insistir en la convicción de hacer primar el elemento técnico-jurídico sobre las consideraciones políticas, a la hora de aplicar los requisitos y exigencias previstos en los distintos ordenamientos.
