Summary: The general objective was to legally analyze the violation of constitutional rights due to cross-death in Ecuador. The researchers used the qualitative method, since it is possible to collect and analyze data, to formulate questions in a research process, where once other questions are generated, an interpretative process is carried out. It was also supported by the synthetic analytical method. In this research work, this method was applied by seeking to decompose the variables into their parts and synthetically concretize the cross-death vs. the constitutional state of rights in Ecuador. The study population were judges, constitutional lawyers and assembly members. It is concluded that the reform of articles 130 and 148 of the 2008 Constitution should be carried out immediately, thus guaranteeing the correct application of legal security and establishing a clear norm with a specific definition.
