Within the framework of the State's international obligations regarding human rights guarantees and DIH; the objective was to make visible the treatment of second occupants in contrast to the measures for victims of dispossession or forced abandonment considered in the Victims' Law. Therefore, through a reflective methodology from a critical perspective; in which, from a systematic review of the legal framework applicable to this population from a global vision provided by international law (Joinet, Deng and Pinheiros principles) and domestic law; it was possible to conclude that the lack of guarantees for second occupants is a constant, due to the deficient accompaniment and frequent vulnerability of these populations.Se incursionó en las implicaciones de la restitución de tierras en etapas de transición frente a segundos ocupantes. En el marco de las obligaciones internacionales del Estado frente a garantías de DDHH y DIH; el objetivo fue visibilizar el tratamiento a los segundos ocupantes en contraste con las medidas frente a las víctimas de despojos o abandono forzado considerados en la ley de víctimas.
