Next, the article – with a focus on Germany – critically examines the question of whether there is a legal framework and a real need for the new forms of alternative dispute resolution introduced at European and national level alongside the traditional forms. This will also take into account that alternative dispute resolution may come into conflict with the so-called judicial fundamental rights of the Basic Law (Grundgesetz), the German constitution.El tema de la resolución alternativa de litigios privados es hoy en día no solo en Alemania, sino en toda la Unión Europea un tema muy actual. El presente artículo explica, en primer lugar, cuáles tipos tradicionales y nuevos de resolución alternativa de litigios privados existen en el Derecho alemán y europeo. A continuación, el artículo – centrado en Alemania – examina críticamente la cuestión de si hay un marco jurídico y una necesidad real para las nuevas formas de resolución alternativa de litigios introducidas a escala europea y nacional junto a las formas tradicionales.
